Terms of Service

These Terms of Service ("Terms") govern your use of the WiseChef platform at wisechef.ai and all related services. By creating an account or using our services, you agree to these Terms.

1. Definitions

• "Platform" — the WiseChef web application, APIs, AI assistants, and agent services.
• "Service" — any feature provided through the Platform, including AI assistants, GEO-SEO audits, social media management, code generation, and business validation.
• "Client", "You" — any individual or entity creating an account on WiseChef.
• "We", "Us" — WiseChef, operated by Adam Krawczyk, Kraków, Poland.
• "VPS" — the dedicated virtual private server provisioned for your account.

2. Account Registration

• You must provide accurate, current information at signup.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old or the age of legal majority in your jurisdiction.
• One person or entity per account. No account sharing or resale unless on an Enterprise plan.

3. Service Description

WiseChef provides AI-powered business automation:

• AI Assistant: A conversational agent deployed to your messaging channels (WhatsApp, Telegram, Signal).
• Agent Team: Specialized AI agents for SEO, social media, development, and validation (Pro/Enterprise plans).
• Dedicated Infrastructure: Each client receives an isolated VPS with their own data, models, and configuration.

4. Pricing and Payment

• Subscription plans are billed monthly via Stripe.
• Prices are in USD. VAT may apply per your jurisdiction.
• You may cancel at any time. Access continues until the end of the billing period.
• No refunds for partial months. We may offer pro-rata credits at our discretion.
• We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree NOT to use WiseChef to:

• Generate or distribute illegal, harmful, or deceptive content
• Impersonate individuals or organizations
• Send spam or unsolicited bulk messages via AI assistants
• Attempt to access other clients' data or infrastructure
• Reverse-engineer, scrape, or resell WiseChef technology
• Use the service for any activity violating applicable law

Violation may result in immediate account termination without refund.

6. Your Data

• You own your data. Content you create, conversations your AI processes, and configurations you build remain yours.
• We do not use your data to train models or sell to third parties.
• Upon account deletion, your VPS and all data are destroyed within 7 days.
• You may export your data at any time via your dashboard or by requesting it from us.

7. API Keys and Third-Party Services

• Some features require you to provide API keys (e.g., OpenRouter for LLM inference).
• You are responsible for costs incurred through your API keys.
• We store API keys encrypted on your dedicated VPS. We do not share them.
• We are not responsible for third-party service outages, pricing changes, or policy violations.

8. Availability and SLA

• We target 99.5% uptime for the platform but do not guarantee it.
• Planned maintenance will be communicated 24 hours in advance when possible.
• Enterprise clients may negotiate custom SLAs.

9. Intellectual Property

• WiseChef, its logo, and platform code are our intellectual property.
• Content generated by AI agents on your behalf belongs to you.
• You grant us a limited license to host and process your data solely to provide the service.

10. Limitation of Liability

To the maximum extent permitted by law:

• WiseChef is provided "as is" without warranties of any kind.
• We are not liable for indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid in the 3 months preceding the claim.
• AI-generated content may contain errors. You are responsible for reviewing and approving all output before use.

11. Termination

• You may cancel your subscription at any time via your dashboard or by contacting us.
• We may suspend or terminate accounts that violate these Terms.
• Upon termination, your VPS and data are destroyed within 7 days (see Section 6).

12. Governing Law

These Terms are governed by Polish law. Disputes shall be resolved in the courts of Kraków, Poland. EU consumers retain rights under their local consumer protection laws.

13. Changes to These Terms

We may update these Terms. Material changes will be notified via email 14 days before taking effect. Continued use after changes constitutes acceptance.
